Should I Settle My Car Wreck Case

Without A Lawyer?

The simple answer is no. At the very least you should talk with an experienced personal injury lawyer before settling your case. There are many things to consider in maximizing the compensation for your injuries and lost income—only a lawyer is qualified to help.

Insurance adjusters do not have your best interest in mind. Despite their super friendly demeanor when talking to you, their allegiance is to the insurance company. Here’s an example.

We recently had a client come into our office with a claim worth in excess of six figures but had been told by an insurance adjuster that the insurance company would offer her $28,000. Her medical bills alone were over $50,000! The adjuster told her it was her job to negotiate reductions with her doctors. This is not true.

In most cases, studies show that injured individuals receive three to five times more money with an attorney than without one! This means a lot more compensation for your injuries and lost wages, even after you pay your attorney.

Also, your attorney should be able to reduce some of your bills and subrogation claims which puts even more money in your pocket.

There are some cases where you may not end up hiring a lawyer, but talking with one before settling is still the best course of action. For example, the person who hurt you may have no insurance or very little insurance.

If you carry uninsured motorist (UM) or underinsured motorist (UIM) coverage, then there may be enough insurance coverage to pay your medical bills and expenses and provide compensation for pain and suffering and lost wages.

That being said, if you do not have UM or UMI coverage, you should purchase it now, because if you do not have it you may receive nothing.

If you are in a situation where the person who hurt you has no insurance or very little insurance, it is still important to have a lawyer look at your case to see if there is another way to recover compensation.

You may have a products liability claim against the manufacturer of your car. Also, sometimes people with plenty of money and assets do not pay for adequate insurance for themselves or their kids. In this case, you may be able to pursue the person directly instead of just receiving insurance compensation.

Talk to an experienced personal injury lawyer before you settle your car wreck case. Even if you do not end up hiring a lawyer, you will still get the peace of mind from knowing your rights and fully exploring all of your options.
